Forced Pharmacy Closure
An effort by politically connected independent pharmacists to undermine their competition through legislation, forced pharmacy closure causes people to lose jobs, lose access to their pharmacy, and raises prices for all Tennesseans. Despite TEBA’s efforts to educate lawmakers and the public about the consequences of the FAIR RX Act, Tennessee passed the bill into law in 2026.

TEBA'S STATEMENT
The Tennessee Employer Benefits Alliance is disappointed that Governor Bill Lee (R-TN) has doubled down on the Tennessee General Assembly’s callous and clueless passage of the FAIR RX Act. Despite testimony from patient advocates, veterans, and the governor’s own TennCare and Finance directors, Governor Lee and the legislature opted to enrich their pharmacist friends at the expense of hardworking Tennesseans.
With his actions, more than a hundred pharmacies will close, drug costs will increase for families and taxpayers will fund an extra $60 million in increased TennCare and state health plan costs. The businesses we represent have worked hard to provide reasonable prescription benefits for their workers. To see that undone by the supposedly pro-business leadership in Tennessee is disheartening and disturbing.
